These Terms of Service ("Terms") govern your use of the GAGA AI platform operated by GAGA AI ("we", "our", or "us"). By creating an account or using our services, you agree to these Terms.

1. Service Description

GAGA AI is an AI-powered customer support platform for e-commerce stores. We provide a chat widget that integrates with your online store, automatically learns your product catalog and policies, and answers customer questions using artificial intelligence. The AI responses are generated automatically based on your store data and are not reviewed by humans before delivery.

2. Account Terms

  • You must provide a valid email address and password to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old or have the legal authority to enter into these Terms on behalf of your business.
  • One person or entity may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

3. Subscription Plans and Billing

GAGA AI offers the following subscription plans:

  • Starter: $29/month — 400 messages per month
  • Pro: $69/month — 2,000 messages per month
  • Enterprise: $149/month — 10,000 messages per month
  • Custom: Pricing available upon request — custom message volume and dedicated support

All plans are billed monthly. Prices are in US Dollars and do not include applicable taxes. We reserve the right to change pricing with 30 days' notice.

4. Free Trial

All new accounts include a 14-day free trial. No credit card is required to start your trial. During the trial period, you have full access to the features of your selected plan. At the end of the trial, you must subscribe to a paid plan to continue using the service. If you do not subscribe, your chat widget will be disabled but your account and data will be preserved.

5. Usage Limits

Each plan includes a monthly message limit. A "message" is defined as one AI-generated response to a customer query. When your store reaches its monthly message limit:

  • The chat widget will be automatically hidden from your storefront.
  • You will be notified in your dashboard as you approach the limit.
  • Your message count resets at the beginning of each calendar month.
  • You can upgrade your plan at any time to increase your limit.

Unused messages do not roll over to the next month.

6. Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose.
  • Attempt to abuse, overload, or interfere with the service or its infrastructure.
  • Use the service to distribute spam, malware, or harmful content.
  • Reverse engineer, decompile, or attempt to extract the source code of the service.
  • Impersonate another person or entity, or misrepresent your affiliation with a person or entity.
  • Use the service in a way that could harm, disable, or impair other users' experience.

7. Intellectual Property

You retain all rights to your data, including your product catalog, policies, FAQs, and conversation history. By using GAGA AI, you grant us a limited license to process this data solely for the purpose of providing the service. We own all rights to the GAGA AI platform, including its software, design, and branding.

8. AI Disclaimer

GAGA AI uses artificial intelligence to generate responses to customer questions. While the AI is designed to provide accurate answers based on your store data, AI-generated responses may occasionally contain errors or inaccuracies. The AI responses do not constitute professional, legal, medical, or financial advice. You are ultimately responsible for the customer support provided through your storefront and should review conversation logs regularly.

9. Limitation of Liability

To the maximum extent permitted by law, GAGA AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Warranty Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or secure.

11. Termination

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your account if you violate these Terms or engage in activities that harm the service or other users. Upon termination, your data will be deleted within 30 days unless you request earlier deletion.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, via email or through a notice on our website. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good faith negotiation, and if necessary, binding arbitration.
